By accessing or using Bunch ("Service"), operated by Bananify Creative ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

These terms apply to all users of the Service, including administrators, team members, and any other individuals who access the platform through a workspace.

Bunch is an all-in-one customer relationship management (CRM), email marketing, and sales platform. Our Service includes:

• Contact and lead management with customizable fields and tagging
• Email campaign creation, scheduling, and delivery
• Marketing automation and workflow builders
• Sales pipeline and deal tracking
• Power dialer for outbound calling (where available)
• Multi-workspace support for managing multiple businesses or clients
• Team collaboration features including comments and activity feeds
• Analytics and reporting dashboards

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent, abusive, or illegal activities.

You agree to use the Service only for lawful purposes. You shall not:

• Send unsolicited bulk emails (spam) or violate anti-spam laws such as CAN-SPAM, GDPR, or CASL
• Upload or transmit malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the Service to harass, threaten, or harm others
• Violate any applicable local, state, national, or international law
• Infringe upon the intellectual property rights of others
• Use the power dialer feature to make calls that violate telemarketing regulations or Do Not Call lists

When using our email marketing features, you agree to:

• Only send emails to recipients who have given valid consent
• Include accurate sender information and a valid physical mailing address
• Honor unsubscribe requests promptly (within 10 business days)
• Maintain clean email lists and remove invalid or bouncing addresses
• Comply with all applicable email marketing laws and regulations

We reserve the right to suspend email sending privileges for accounts with high bounce rates, spam complaints, or that otherwise violate these guidelines.

If you use our power dialer or calling features, you agree to:

• Comply with all applicable telemarketing laws and regulations, including the Telephone Consumer Protection Act (TCPA)
• Obtain proper consent before making calls to consumers
• Respect Do Not Call (DNC) lists and scrub your calling lists accordingly
• Not use auto-dialers to call numbers on the National Do Not Call Registry without prior express consent
• Identify yourself and the purpose of your call at the beginning of each conversation

You are solely responsible for ensuring your calling practices comply with applicable laws. We are not liable for any violations of telemarketing regulations.

Bunch supports multiple workspaces and team collaboration. By using these features:

• Workspace administrators are responsible for managing user access and permissions
• Data within each workspace is isolated and accessible only to authorized users
• You agree not to share login credentials with unauthorized individuals
• You understand that workspace owners can view activity and data within their workspaces

You retain ownership of any data, content, or materials you upload to the Service ("User Content"). By uploading User Content, you grant us a limited license to store, process, and display this content as necessary to provide the Service.

You are responsible for maintaining backups of your data. While we implement reasonable measures to protect your data, we recommend regularly exporting important information.

Certain features of the Service may require payment. If you subscribe to a paid plan:

• You agree to pay all applicable fees as described at the time of purchase
• Subscriptions automatically renew unless cancelled before the renewal date
• Refunds are handled on a case-by-case basis at our discretion
• We may change pricing with 30 days' notice before your next billing cycle

The Service, including its original content, features, and functionality, is owned by Bananify Creative and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.

To the maximum extent permitted by law, Bananify Creative shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms.

You may cancel your account at any time through your account settings or by contacting our support team. Upon cancellation, your right to use the Service will cease immediately.

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
